Terms of Service

1. Who we are and what these terms cover

Diaper Domination (the "Game") is made by Better Path Works LLC, a Tennessee limited liability company ("we", "us"). These Terms of Service ("Terms") are an agreement between you and us. They cover the Game, its updates, and this website.

By downloading, installing or playing the Game you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Game.

You also have to follow the terms of the store you got the Game from (the Apple App Store or Google Play). If these Terms conflict with a store's mandatory terms, the store's terms win to the extent of the conflict.

2. Who can play

The Game is meant for players aged 13 and older. If you are under the age of majority where you live, you may only use the Game, and make purchases, with the permission of a parent or legal guardian. They agree to these Terms on your behalf and are responsible for your use of the Game.

3. Your licence to play

We give you a personal, limited, non-exclusive, non-transferable, revocable licence to install and play the Game on devices you own or control, for your own non-commercial entertainment. We own the Game. You get a licence to use it, not ownership of it.

You agree not to:

• copy, sell, rent, sublicense or redistribute the Game or any part of it;
• reverse engineer, decompile or modify the Game, except where the law expressly allows it;
• use cheats, hacks, modified clients, save editors or other tools to unlock paid content, fake purchases, or get ad rewards without watching the ad;
• interfere with the Game's advertising, purchase or security features;
• use the Game in any way that breaks the law.

4. In-game currency and items

The Game has virtual items, such as in-game cash, currencies, boosts, costumes, perks and other content ("Virtual Items"). Some can be earned by playing, some by watching optional ads, and some may be bought with real money.

• A licence, not property. Virtual Items are part of your licence to use the Game. You don't own them. They have no cash value and can't be exchanged for money, sold, traded or transferred, inside or outside the Game.
• We can change things. To keep the Game fun and fair, we may change, rebalance, rename or remove Virtual Items, prices and in-game rates in updates.
• No refunds from us. Except where the law requires otherwise, all purchases are final and we don't give refunds or credits for Virtual Items, whether used or unused.

5. Purchases

Real-money purchases are made through the Apple App Store or Google Play and are processed under their terms. Prices are shown in the store before you buy, and may include taxes.

Refund requests go to the store you bought from:

If a purchase doesn't arrive in your game, use Restore Purchases in Settings (where available) or contact us. Purchases you get refunded or charge back may be removed from your game.

You can turn off in-app purchases in your device's parental controls.

6. Rewarded ads

The Game may offer optional ads that give an in-game reward when watched in full. Watching is always your choice.

• Availability. Ads come from third-party ad networks and aren't always available. We don't guarantee an ad, or a reward, will be available at any time.
• Rewards. Rewards are Virtual Items (see section 4). We may change rewards or limit how often you can earn them. We may withhold rewards obtained by blocking, skipping or manipulating ads.
• Advertisers. Ads are provided by third parties, and we don't control or endorse what they advertise. Anything you do with an advertiser, such as clicking through or buying, is between you and them.

How ads use data is explained in our Privacy Policy.

7. Your saved game

Your progress is stored only on your device. Uninstalling the Game, clearing its data, losing your device, or using Delete all progress can erase it, including Virtual Items you bought. We can't see or restore your save. Use Export Save in Settings to keep a backup. Purchases that the store lets you restore (such as permanent unlocks) can be restored with Restore Purchases where available. Consumable items, like currency you have already received, can't be restored.

8. Satire and our content

The Game is a parody. All companies, brands, products, people, organizations and conspiracies in it are fictional or used satirically. Any resemblance to real ones is for comedic purposes and isn't a statement of fact or an endorsement. "Diapers Inc." is a fictional company inside the Game.

The Game's code, artwork, characters, writing, music and other content belong to Better Path Works LLC or its licensors and are protected by copyright and other laws. Open-source components are used under their own licences, listed in the Game's Settings → About → Licenses.

9. Changes to the Game

We may update, change, suspend or stop offering the Game, or any feature or content in it, at any time. Where practical, we'll give notice in the Game or on this website before discontinuing it. If we discontinue the Game, Virtual Items will no longer be usable, and we have no obligation to refund them except as required by law.

10. Ending these Terms

You can stop using the Game at any time by deleting it. We may end or suspend your licence if you seriously or repeatedly break these Terms, for example by cheating to obtain paid content. Sections 4, 8 and 11 through 15 survive the end of these Terms.

11. Disclaimer

The Game is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We don't promise that the Game will be uninterrupted, error-free, or free of harmful components, or that saves or Virtual Items will never be lost.

12. Limitation of liability

To the fullest extent permitted by law, Better Path Works LLC and its members, managers, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, progress, Virtual Items, profits or goodwill, arising from or related to the Game or these Terms. Our total liability for any claim relating to the Game or these Terms is limited to the greater of (a) the amount you paid us for the Game and Virtual Items in the 12 months before the claim arose, or (b) US $50.

Some places don't allow some of these exclusions or limits, so they may not fully apply to you. Nothing in these Terms limits rights you have under consumer protection laws that can't be waived.

13. Indemnity

To the extent permitted by law, you agree to defend and indemnify Better Path Works LLC against claims, losses and costs (including reasonable legal fees) arising from your misuse of the Game or your breach of these Terms.

14. Governing law and disputes

These Terms are governed by the laws of the State of Tennessee, USA, without regard to its conflict-of-law rules. Before filing a claim, please email us at info@explorebetterpath.com so we can try to resolve it informally. If we can't resolve it within 60 days, any dispute must be brought in the state or federal courts located in Tennessee, and you and we consent to their jurisdiction. Either of us may instead bring an individual claim in small claims court. If you live in a country whose laws give you the right to bring a claim in your local courts, these Terms don't take that right away.

15. Apple App Store terms

If you downloaded the Game from the Apple App Store, you and we also agree that:

• These Terms are between you and Better Path Works LLC only, not Apple. We, not Apple, are solely responsible for the Game and its content.
• Your licence is limited to using the Game on Apple-branded devices you own or control, as permitted by the App Store's Usage Rules.
• Apple has no obligation to provide maintenance or support for the Game.
• If the Game fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Game. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Game.
• We, not Apple, are responsible for addressing any claims by you or a third party relating to the Game, including product liability claims, claims that the Game fails to conform to legal or regulatory requirements, and consumer protection or privacy claims.
• If a third party claims the Game or your use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

16. General

If any part of these Terms is found unenforceable, the rest stays in effect. If we don't enforce a right, that doesn't waive it. You may not transfer these Terms; we may transfer them as part of a merger, acquisition or sale of the Game. These Terms and our Privacy Policy are the entire agreement between you and us about the Game.

17. Changes to these Terms

We may update these Terms, for example when we add features like purchases or ads. We'll change the date at the top, and for significant changes we'll give notice in the Game or on this website before they take effect. If you keep playing after changes take effect, you accept the updated Terms.
